1. General provisions and definitions

These Terms of Use ("Terms") govern the use of the Očisti online platform (ocisti.hr), including the public provider search ("Marketplace") and the business-management tool ("CRM"). The Očisti platform (the "Platform") is operated by MFB Solutions, obrt za digitalne, poslovne i uslužne djelatnosti, vl. Martina Bilić (OIB: 88092973161), Jagnjić Dol, Klenovec 6, 10431 Sveta Nedelja, Hrvatska. Definitions: a "Customer" is a person who searches for and books cleaning or equipment-rental services through the Platform. A "Provider" is a registered company or sole trader offering cleaning or equipment-rental services through the Platform. A "Guest" is a Customer who books a service without creating an account. By using the Platform you accept these Terms and the Privacy Policy.

2. Role of the platform: intermediary

Očisti is purely an intermediary online service connecting Customers and Providers. The contract for cleaning or equipment-rental services is formed exclusively between the Customer and the Provider. Očisti is not a party to that contract, does not itself provide cleaning or rental services, and is not responsible for their performance, quality, timing, or any resulting damage. Payment for the service is arranged and made directly between the Customer and the Provider, outside the Platform. Očisti does not charge, receive, or forward payments for Customer services (see §4 for how Provider subscriptions are billed). We recommend that Providers carry appropriate business liability insurance for any damage they may cause while performing a service. Očisti does not verify or guarantee that such insurance exists.

3. Registration and accounts

A Customer registers with minimal data (email); first/last name, phone and address are requested only at the time of the first booking. A Guest may book a service without creating an account, providing the same details directly in the booking form. Providers may only register as a legal entity or sole trader. The Platform does not accept individuals who are not registered to carry out the relevant business activity. During onboarding, a Provider submits its legal name, tax ID (OIB), address, and contact details; the tax ID is verified before the profile is published on the Marketplace, in line with the trader-traceability requirement (DSA Art. 30). The Provider is responsible for the accuracy and currency of all data it submits. Prices for services entered by a Provider are displayed on the Platform exactly as entered and constitute the Provider's advertising of its prices, including for the purposes of the Croatian Ordinance on the Display of the Dual (Anchor) Price (Official Gazette 101/2026). The Provider is responsible for the accuracy of all pricing data, including the additional (anchor) price that applied to the service on 10 September 2026. The Platform does not verify this data and does not guarantee its accuracy. Customers and Providers are responsible for safeguarding their account credentials and for all activity carried out through their account.

4. Provider subscription

Providers access the Platform through a subscription: €29/month or €290/year, billed in advance via Stripe from the moment of activation (no trial period). Billing renews automatically at the start of each billing period until the subscription is cancelled. VAT not charged pursuant to Article 90(2) of the Croatian VAT Act. This subscription offer is directed exclusively at business entities (companies and sole traders), not consumers. The subscription may be cancelled at any time through the Stripe Customer Portal or in writing to info@ocisti.hr; cancellation takes effect at the end of the current (paid) billing period. The subscription remains active until then. REFUNDS: amounts paid for the subscription are not refunded automatically, including in the event of early cancellation, an unused period, or the Provider ceasing operations. Requests for a refund or cancellation adjustment are reviewed individually. Email info@ocisti.hr with the invoice/transaction number and the reason for your request; we decide on refunds on a case-by-case basis, with no automatic entitlement to a refund.

5. Booking rules

A booking submitted through the Marketplace is a request from the Customer that the Provider confirms ("Accepted") or declines ("Declined"). A booking is not binding until the Provider accepts it. A Customer may cancel a booking up to 24 hours before the appointment via "My bookings"; cancelling later than that is treated as a no-show and remains on record. A Provider who fails to show up for a confirmed appointment, or who repeatedly fails to respond to booking requests, risks being removed from the Marketplace (see §9).

6. Reviews

Only a Customer who has completed a booking with a given Provider through the Platform (status "Completed") may leave a review for that Provider. Reviews cannot be left without a prior recorded booking. Reviews are moderated. Očisti may remove a review that breaches general rules of fair and truthful representation (e.g. hate speech, third-party personal data, clearly false content), but does not edit or remove reviews simply because they are negative.

7. Ranking of providers in search results

The order in which Providers appear on the Marketplace is determined by clear, pre-defined parameters (e.g. distance from the Customer, rating, number of reviews, profile completeness, slot availability). The default ordering cannot be bought. The main ranking parameters and their relative importance are explained in detail on the publicly available "How we rank" page (/kako-rangiramo), in accordance with Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services (the "P2B Regulation").

8. Prohibited conduct

It is prohibited to: submit false or someone else's data during registration; impersonate a Provider or Customer; leave reviews without an actual booking; or use the Platform to send unsolicited messages or content that breaches the law. Arranging a service directly with a Provider outside the Platform (e.g. after first connecting through the Marketplace) is not prohibited. Payment for the service is in any case always made directly between the Customer and the Provider (§2). We simply note that bookings made through the Platform leave a clean record (confirmation, history, ability to leave a review) that arrangements made outside the Platform do not provide.

9. Liability and limitations

Očisti makes reasonable efforts to ensure that Provider information (prices, availability, service descriptions) is accurate and up to date, but does not guarantee its complete accuracy at all times. This information is entered and maintained by the Provider itself. Očisti is not liable for damage arising from the performance, non-performance, or poor execution of a cleaning or equipment-rental service, nor for any direct, indirect, or consequential damage arising from use of the Platform, to the extent permitted by applicable law. Očisti reserves the right to temporarily or permanently remove a Provider's profile from the Marketplace in the event of a breach of these Terms, materially inaccurate information, or repeated Customer complaints.

10. Written complaints

You may submit a written complaint about the Platform by email to info@ocisti.hr, marked "Complaint". We respond to every written complaint in writing no later than 15 days after receipt. We keep records of complaints for one year. A complaint relating to a cleaning or equipment-rental service is submitted directly to the Provider with whom the contract was formed; the Platform is an intermediary.

11. Changes to these terms

We may amend these Terms from time to time to comply with the law, to reflect new Platform features, or for business reasons. We will notify you of material changes through a notice on the Platform or by email. Continued use of the Platform after changes are published constitutes acceptance of the new Terms; if you do not agree with the changes, stop using the Platform and, if you wish, request deletion of your account (see the Privacy Policy).

12. Governing law and jurisdiction

These Terms and your use of the Platform are governed by the law of the Republic of Croatia. Any disputes fall under the jurisdiction of the court in Novi Zagreb (Zagreb), unless mandatory consumer-protection rules provide otherwise (e.g. jurisdiction based on the consumer's place of residence).
